شروط الاستخدام

1. قبول الشروط

باستخدامك لتطبيق مؤونة ("التطبيق")، فإنك توافق على الالتزام بهذه الشروط والأحكام. إذا لم توافق على أي من هذه الشروط، يرجى عدم استخدام التطبيق.

تُقرأ هذه الشروط مع سياسة الخصوصية الخاصة بنا، والتي تشكّل جزءا لا يتجزأ من هذه الاتفاقية.

2. وصف الخدمة

مؤونة هو تطبيق تخطيط وجبات مدعوم بالذكاء الاصطناعي مصمم للعائلات في دول مجلس التعاون الخليجي. يوفر التطبيق:

• تخطيط وجبات أسبوعي مخصص باستخدام الذكاء الاصطناعي
• اقتراحات وصفات ذكية مبنية على تفضيلاتك
• إدارة قوائم البقالة والمخزن
• مشاركة خطط الوجبات والقوائم مع أفراد العائلة
• استخراج الوصفات من روابط الإنترنت ومقاطع الفيديو
• مسح بصري للمكونات بالكاميرا
• تتبع جلسات الطبخ
• تخطيط حفلات العشاء

3. التسجيل وأمان الحساب

• يجب أن يكون عمرك 13 سنة أو أكثر لاستخدام التطبيق.
• يمكنك التسجيل عبر البريد الإلكتروني (رابط سحري)، أو Google Sign-In، أو Apple Sign-In.
• أنت مسؤول عن الحفاظ على أمان حسابك وجميع الأنشطة التي تتم تحته.
• يجب أن تكون المعلومات التي تقدمها دقيقة وكاملة ومحدّثة.
• يجب إخطارنا فورا في حال الشك بأي استخدام غير مصرّح به لحسابك.

4. الاشتراكات والمدفوعات

4.1 خطط الاشتراك

يوفر التطبيق مستويات خدمة متعددة:

• المجاني: ميزات أساسية محدودة
• Premium (المميز): جميع الميزات لمستخدم واحد
• Family (العائلي): جميع الميزات مع مشاركة عائلية

4.2 التجديد التلقائي

4.3 الإلغاء

• يمكنك إلغاء اشتراكك في أي وقت عبر إعدادات App Store أو Google Play.
• يسري الإلغاء في نهاية فترة الاشتراك الحالية — لن تفقد الوصول فورا.
• لا تُسترد المبالغ المدفوعة عن الفترات المتبقية بعد الإلغاء.

4.4 أرصدة الذكاء الاصطناعي (كريدت)

• بعض الميزات تستهلك أرصدة (كريدت) من رصيدك.
• الأرصدة الشهرية تتجدد مع كل فترة اشتراك ولا تُنقل للفترة التالية.
• أرصدة الشراء الإضافي (Top-up) لا تنتهي صلاحيتها.
• الأرصدة غير قابلة للاسترداد أو التحويل النقدي.

4.5 المدفوعات

تتم جميع المدفوعات عبر Apple App Store أو Google Play Store. لا نعالج بيانات الدفع مباشرة. تخضع المدفوعات لشروط وأحكام Apple أو Google المعمول بها.

5. المحتوى المُولَّد بالذكاء الاصطناعي

• لا نضمن دقة أو اكتمال أو ملاءمة المحتوى المُولَّد بالذكاء الاصطناعي.
• رغم أننا نأخذ الحساسيات الغذائية بعين الاعتبار، يجب عليك دائما التحقق من المكونات بنفسك، خاصة في حالات الحساسية الشديدة.
• لا يُعتبر التطبيق مصدرا للنصائح الطبية أو الغذائية. استشر طبيبك أو أخصائي التغذية للحالات الصحية.
• التقديرات الغذائية (السعرات الحرارية، الماكرو) هي تقريبية وقد تختلف عن القيم الفعلية.

6. المحتوى الذي ينشئه المستخدم

• أنت تحتفظ بملكية المحتوى الذي تنشئه (وصفات شخصية، صور، ملاحظات).
• بنشر محتوى في التطبيق، تمنحنا ترخيصا غير حصري لاستخدامه ضمن نطاق توفير الخدمة لك ولعائلتك.
• لا يجوز لك نشر محتوى غير قانوني، مسيء، أو ينتهك حقوق الملكية الفكرية للغير.
• نحتفظ بالحق في إزالة أي محتوى ينتهك هذه الشروط.

7. ميزات المشاركة العائلية

• مدير العائلة يمكنه دعوة أعضاء جدد عبر رمز الدعوة أو رابط المشاركة.
• جميع أعضاء العائلة يتشاركون خطط الوجبات وقوائم البقالة والتفضيلات.
• مدير العائلة مسؤول عن إدارة الأعضاء والأذونات.
• مغادرة العائلة تعني فقدان الوصول للبيانات المشتركة.
• حذف العائلة يؤدي لإزالة جميع البيانات المشتركة بشكل نهائي.

8. الملكية الفكرية

• تطبيق مؤونة وجميع محتوياته (التصميم، الشعار، الكود، قاعدة البيانات) هي ملكية فكرية لمؤونة.
• الوصفات المتوفرة في التطبيق قد تكون من مصادر متعددة مع الإشارة للمصدر عند الإمكان.
• لا يجوز نسخ أو توزيع أو تعديل أو إعادة إنتاج أي جزء من التطبيق بدون إذن كتابي مسبق.

9. الاستخدام المقبول

توافق على عدم:

• استخدام التطبيق لأي غرض غير قانوني
• محاولة الوصول غير المصرّح به لأنظمتنا أو حسابات المستخدمين الآخرين
• إساءة استخدام أرصدة الذكاء الاصطناعي أو محاولة التلاعب بالنظام
• استخدام أدوات آلية لاستخراج البيانات من التطبيق
• انتحال شخصية مستخدم آخر
• مشاركة معلومات كاذبة عن الحساسيات الغذائية التي قد تعرّض الآخرين للخطر

10. تحديد المسؤولية

• يُقدَّم التطبيق "كما هو" و"حسب التوفر" بدون أي ضمانات صريحة أو ضمنية.
• لا نتحمل المسؤولية عن أي أضرار مباشرة أو غير مباشرة أو عرضية أو تبعية ناتجة عن استخدام التطبيق.
• لا نتحمل المسؤولية عن ردود الفعل التحسسية الناتجة عن الاعتماد على اقتراحات الذكاء الاصطناعي — يجب التحقق من المكونات دائما.
• في جميع الأحوال، لا تتجاوز مسؤوليتنا الإجمالية المبلغ الذي دفعته لنا خلال الأشهر الـ 12 السابقة.

11. التعويض

توافق على تعويضنا وحمايتنا من أي مطالبات أو أضرار أو تكاليف (بما في ذلك أتعاب المحاماة) ناتجة عن:

• انتهاكك لهذه الشروط
• استخدامك للتطبيق
• انتهاكك لحقوق أي طرف ثالث

12. القانون الحاكم

تخضع هذه الشروط لأنظمة المملكة العربية السعودية وتُفسَّر وفقا لها. أي نزاع ينشأ عن هذه الشروط أو يتعلق بها يخضع للاختصاص القضائي الحصري لمحاكم المملكة العربية السعودية.

13. حل النزاعات

في حال وجود أي نزاع، نشجعك على التواصل معنا أولا عبر info@mawonah.com لمحاولة حله وديا. إذا لم يتم الحل خلال 30 يوما، يمكن لأي طرف اللجوء للقضاء وفقا للقانون الحاكم.

14. إنهاء الخدمة

• يمكنك إنهاء حسابك في أي وقت عبر حذف الحساب من إعدادات التطبيق.
• نحتفظ بالحق في تعليق أو إنهاء حسابك في حال انتهاك هذه الشروط.
• عند الإنهاء، يتوقف وصولك لجميع الخدمات المدفوعة فورا.
• البيانات المرتبطة بحسابك تُحذف وفقا لسياسة الاحتفاظ بالبيانات في سياسة الخصوصية.

15. التعديلات على هذه الشروط

نحتفظ بالحق في تعديل هذه الشروط في أي وقت. سنُخطرك بالتغييرات الجوهرية عبر:

• إشعار داخل التطبيق
• تحديث تاريخ السريان في أعلى هذه الصفحة

استمرارك في استخدام التطبيق بعد التعديل يُعتبر موافقة على الشروط المحدّثة.

1. Acceptance of Terms

By using Mawonah ("the App"), you agree to be bound by these terms and conditions. If you do not agree to any of these terms, please do not use the App.

These terms should be read together with our Privacy Policy, which forms an integral part of this agreement.

2. Description of Service

Mawonah is an AI-powered meal planning app designed for families in GCC countries. The app provides:

• Customized weekly meal planning using artificial intelligence
• Smart recipe suggestions based on your preferences
• Grocery list and pantry management
• Sharing meal plans and lists with family members
• Recipe extraction from web links and videos
• Visual ingredient scanning with camera
• Cooking session tracking
• Dinner party planning

3. Registration & Account Security

• You must be 13 years of age or older to use the App.
• You can register via email (Magic Link), Google Sign-In, or Apple Sign-In.
• You are responsible for maintaining the security of your account and all activities under it.
• Information you provide must be accurate, complete, and up-to-date.
• You must notify us immediately if you suspect unauthorized use of your account.

4. Subscriptions & Payments

4.1 Subscription Plans

The app offers multiple service tiers:

• Free: Limited basic features
• Premium: All features for a single user
• Family: All features with family sharing

4.2 Auto-Renewal

4.3 Cancellation

• You can cancel your subscription at any time through App Store or Google Play settings.
• Cancellation takes effect at the end of the current subscription period — you will not lose access immediately.
• No refunds are provided for remaining periods after cancellation.

4.4 AI Credits

• Some features consume credits from your balance.
• Monthly credits renew with each subscription period and do not carry over.
• Top-up (purchased) credits do not expire.
• Credits are non-refundable and non-transferable.

4.5 Payments

All payments are processed through Apple App Store or Google Play Store. We do not process payment data directly. Payments are subject to applicable Apple or Google terms and conditions.

5. AI-Generated Content

• We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
• While we account for food allergies, you must always verify ingredients yourself, especially in cases of severe allergies.
• The app is not a source of medical or nutritional advice. Consult your doctor or dietitian for health conditions.
• Nutritional estimates (calories, macros) are approximate and may differ from actual values.

6. User-Generated Content

• You retain ownership of content you create (personal recipes, photos, notes).
• By posting content in the App, you grant us a non-exclusive license to use it within the scope of providing the service to you and your family.
• You may not post content that is illegal, offensive, or infringes on third-party intellectual property rights.
• We reserve the right to remove any content that violates these terms.

7. Family Sharing Features

• The family admin can invite new members via invite code or share link.
• All family members share meal plans, grocery lists, and preferences.
• The family admin is responsible for managing members and permissions.
• Leaving a family means losing access to shared data.
• Deleting a family permanently removes all shared data.

8. Intellectual Property

• The Mawonah app and all its content (design, logo, code, database) are the intellectual property of Mawonah.
• Recipes available in the app may come from multiple sources with attribution where possible.
• You may not copy, distribute, modify, or reproduce any part of the app without prior written permission.

9. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt unauthorized access to our systems or other users' accounts
• Abuse AI credits or attempt to manipulate the system
• Use automated tools to extract data from the App
• Impersonate another user
• Share false allergy information that could endanger others

10. Limitation of Liability

• The App is provided "as is" and "as available" without any express or implied warranties.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from use of the App.
• We are not liable for allergic reactions resulting from reliance on AI suggestions — always verify ingredients.
• In all cases, our total liability shall not exceed the amount you paid us in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or costs (including attorney fees) arising from:

• Your violation of these terms
• Your use of the App
• Your violation of any third-party rights

12. Governing Law

These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia.

13. Dispute Resolution

In case of any dispute, we encourage you to first contact us at info@mawonah.com to attempt an amicable resolution. If not resolved within 30 days, either party may resort to litigation under the governing law.

14. Termination

• You can terminate your account at any time by deleting your account from the app settings.
• We reserve the right to suspend or terminate your account for violation of these terms.
• Upon termination, your access to all paid services stops immediately.
• Data associated with your account is deleted according to the data retention policy in our Privacy Policy.

15. Changes to These Terms

We reserve the right to modify these terms at any time. We will notify you of material changes through:

• An in-app notification
• Updating the effective date at the top of this page

Your continued use of the App after modifications constitutes acceptance of the updated terms.
